Welcome to Online Therapy Tools ("Platform," "we," "our," or "us," onlinetherapytools.com). Online Therapy Tools partners with The Counseling Palette, owned by Jennie Lannette Bedsworth, LCSW, a registered trauma-focused CBT therapist experienced in expressive therapy, sand tray therapy, and other creative modalities. Jennie runs Online Therapy Tools with the assistance of a technical developer. We are a small business with no fulltime staff.

By accessing or using Online Therapy Tools, you ("User," "you," or "your") agree to comply with and be bound by the following Terms and Conditions ("Terms"). If you do not agree, you may not use the Platform.

1. Purpose of the Platform

Online Therapy Tools provides interactive therapy-related activities, games, and creative exercises intended for therapist-led use within the scope of a professional's licensure, certification, and applicable laws.

Activities are not a substitute for medical or mental health treatment. Rather they are tools that may be used by professionals within their scope of practice.

By joining and using our platform you understand that you are considered a professional customer of Online Therapy Tools. We do not provide services directly to patients or clients but rather offer tools for professionals, like therapists and counselors, to use in their work.

Certain activities, such as quiz show-style games, are primarily discussion-based and do not have "correct" answers; they are intended to facilitate conversation and engagement under therapist guidance. Other activities are expressive and may be used for a variety of purposes within various modalities.

You are solely responsible for ensuring the use of any activity is within your scope of practice, in compliance with applicable regulations, and safe and appropriate for your customers or clients.

2. Beta Status and Service Availability

The Platform is currently in beta. This means:

By using the Platform during beta, you acknowledge these limitations and agree to provide feedback when possible so we can improve the service. We reserve the right to modify, suspend, or discontinue features at any time.

3. Membership and Payment

The cost of the current platform and all available activities is $11.99 per month to be billed monthly. In some cases we may offer special promotional pricing (credit card required), as well as promotions in collaboration with other organizations, groups, or businesses. These will be noted in the platform's pricing or in promotional materials.

Future Changes: In the future we may also offer additional premium activities or add-ons for an extra cost, available as long as you maintain a paid subscription. On occasion, special access may be granted to testers, beta users, or partners to preview activities. They remain subject to all other Terms and Conditions.

Billing Services: We partner with a company called Stripe to manage credit cards and billing information. Stripe is used by many of the biggest companies in the world and you may notice that many other subscription services use them to manage billing. You may receive various communications from Stripe relating to your billing or membership.

Changing Model: We may in the future change our membership model based on what we learn during the beta phase or later. We will keep you informed of any changes.

Fees and Taxes: You are responsible for any subscription fees and taxes associated with your account.

All content, designs, software, images, and activities are the property of Jennie Bedsworth and Online Therapy Tools unless otherwise noted. You are granted a limited, non-exclusive license to use the Platform for professional purposes within your scope of practice.

6. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties. We do not guarantee specific results or outcomes from the use of our activities.

7. Limitation of Liability

We are not liable for indirect or consequential damages. Our maximum liability will not exceed the amount you paid in the 3 months prior to the claim.

8. Your Privacy and Marketing

By signing up, you consent to receive marketing emails unless otherwise noted. We handle personal data under our Privacy Policy, including CCPA rights for California users.

9. Termination

We may suspend or terminate your account for violations of these Terms. You may cancel anytime; cancellations take effect at the end of your billing cycle.

10. Creative Works and Privacy

We designed this platform to avoid collecting your client(s)' data. Therapists can generate temporary, anonymous session links so their own clients never log in or share personal details to use the activities.

Some activities (such as drawing or sand tray apps) allow clients to create and express. Clients can download copies of their creations, but we never store them. Once a browser is closed, the creation will be lost. In other cases browsers may be unintentionally refreshed or there may be other situations where creative work can be lost in progress. Although creative works are not "saved" due to privacy concerns, you or your clients can capture images of them to keep. You are responsible for making sure any creative work is captured early and often. Many of the activities have "Download" options included. You should make sure the downloads have effectively been saved on the intended device and have the intended image. You or your clients can also use the computer's "screensave" functions to preserve an image of their work if the download button is not available or not working.

11. Your Clients' Information and HIPAA

HIPAA is a set of rules and guidelines around collecting and storing health information and data. While we collect your data as a subscriber to our platform, we actively avoid collecting, tracking, or storing any of your clients' or patients' information. We intentionally created private, expiring links so that your clients can use the platform without logging in. We also chose specific tools such as our particular hosting platform to avoid others from storing your clients' visits or data. We have made every effort to create HIPAA-consistent security, although we can't technically call ourselves HIPAA compliant because we don't have any data storage or client data to comply around!

12. Limited Use of Expiring Links

At this time we are providing a reasonable number of uses per month of our activities of around 100 uses per month or more. This isn't intended to limit use by you or your own clients but rather to decrease the possibility of misuse or sharing of links beyond the scope of use with each customers' own clients. If you find you are legitimately using more links and need additional access please contact us for custom arrangements. To decrease your number of uses you may also use our studio environments which provided access to numerous activities per one session with only one client link required.

13. Refund & Cancellation Policy

At Online Therapy Tools we strive to provide immediate access to our interactive activities and resources once your membership begins. Because of this, we do not offer refunds on subscription payments.
